Explanation using Example
Imagine a situation where the government decides to acquire a piece of land to build a new highway. The land is owned by three siblings who inherited it from their parents. The government, through the Collector, has determined the amount of compensation to be paid for the land. However, the siblings cannot agree on how to divide the compensation among themselves. One sibling believes they should get a larger share because they have been taking care of the land, while the other two siblings want an equal division.
In this case, since there is a dispute regarding the apportionment of the compensation, the Collector can use Section 76 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, to refer this dispute to the appropriate Authority for resolution. This Authority will then decide how the compensation should be divided among the siblings.
