Explanation using Example
Imagine Mr. Sharma has purchased an apartment in a new residential complex called "Sunrise Apartments" developed by XYZ Builders. According to Section 17 of The Real Estate (Regulation and Development) Act, 2016, after the construction is completed, XYZ Builders are required to execute a registered conveyance deed in favor of Mr. Sharma. This deed will not only transfer the ownership of the apartment to Mr. Sharma but also give him a proportionate title in the common areas of the complex, such as the garden, swimming pool, and clubhouse.
Furthermore, once XYZ Builders obtain the occupancy certificate, they must hand over the physical possession of the apartment to Mr. Sharma. In addition to the apartment, XYZ Builders are also responsible for handing over the title documents and plans related to the common areas to the association of the apartment owners, which includes Mr. Sharma and other residents. If there are no specific local laws dictating the timeframe for these actions, XYZ Builders must complete the conveyance deed within three months of obtaining the occupancy certificate, and deliver the necessary documents and plans within thirty days of receiving the completion certificate.
