Explanation using Example

Imagine John is traveling by train after attending a party where he had several drinks. During the journey, he becomes loud and starts using offensive language towards other passengers. His behavior is causing discomfort to those around him. A railway official notices John's behavior and decides to take action.

Under Section 145 of The Railways Act, 1989, the official has the authority to remove John from the train for being intoxicated and for using abusive language, both of which are causing a nuisance to other passengers. The official informs John that not only is he being removed from the train, but he is also subject to legal action for his conduct.

John could face a fine and possibly imprisonment for his actions. If it's his first offense, the court will likely impose a minimum fine of one hundred rupees, but if he has been convicted for similar offenses before, he could face a minimum of one month of imprisonment and a fine of two hundred and fifty rupees.
