Explanation using Example

Imagine Rahul rents an apartment from Priya, and the monthly rent is INR 4,000. After a few months, Rahul stops paying the rent. Priya decides to take legal action to recover the unpaid rent, which totals INR 12,000. Since the amount is below INR 500, she can file her suit in a Court of Small Causes, as it falls within the jurisdictional monetary limit mentioned in (2).

However, if Rahul had caused damage to the property that Priya claims is worth INR 15,000, Priya would not be able to file this suit in a Court of Small Causes if the State Government has not exercised its power under (3) to increase the jurisdictional limit to INR 1,000 or more. Additionally, if Priya's claim involved a dispute over property ownership, even if the value was below INR 500, she would have to seek resolution in a different court, as such disputes are typically excepted from the cognizance of a Court of Small Causes under the second schedule referred to in (1).
