Explanation using Example
Imagine a woman named Priya has obtained a protection order against her husband, Rahul, due to domestic abuse. This order, issued under Section 18 of The Protection of Women from Domestic Violence Act, 2005, prohibits Rahul from entering Priya's place of work and from contacting her.
As per (1), this protection order will remain in effect until Priya decides to apply for its discharge, meaning that as long as she feels threatened, the order will continue to protect her.
After some time, Rahul undergoes counseling and demonstrates significant behavioral changes. Priya believes that the threat has diminished and wants to allow Rahul to communicate with her for the sake of their children. She applies to the Magistrate for an alteration of the protection order.
In line with (2), the Magistrate reviews Priya's application and, acknowledging the change in Rahul's behavior, decides to modify the order to allow Rahul to see the children once a week under supervision. The Magistrate records the reasons for this modification in writing, ensuring that the order's alteration is transparent and justified.
