Explanation using Example

Example Application of Section 8 of The Prevention of Corruption Act, 1988:

Imagine a businessman, Mr. Gupta, is seeking to expedite the process of obtaining a building permit for his new construction project. He knows that the process can be lengthy and wishes to avoid delays. He approaches Mr. Sharma, a public servant working in the municipal office that issues building permits. Mr. Gupta offers Mr. Sharma a sum of money as a "token of appreciation" if Mr. Sharma ensures that his permit is processed before others.

Mr. Sharma accepts the offer and processes Mr. Gupta's permit quickly. In this scenario, Mr. Gupta has committed an offence under Section 8(1) of The Prevention of Corruption Act because he gave an undue advantage to Mr. Sharma with the intention of inducing him to perform his public duty improperly. Mr. Gupta can be punishable with imprisonment, a fine, or both, according to the provisions of this law.
