Imagine a company, "TransOil Corporation," is planning to lay a petroleum pipeline that will traverse through several states in India. As per the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962, they refer to Section 1 to understand the scope of the Act. They learn that the Act is applicable throughout India, with the exception of Jammu and Kashmir.
Since the pipeline is proposed to pass through Uttar Pradesh, which is mentioned in the Act, they know that the provisions of the Act automatically apply. However, they also plan to extend the pipeline to Rajasthan. They will need to check whether the Central Government has issued a notification applying the Act to Rajasthan. If not, TransOil Corporation may have to wait until such a notification is issued or seek alternative routes for their pipeline that fall within the states where the Act is already applicable.
