Explanation using Example
Imagine Dr. Smith, a cardiologist in New Delhi, has recently moved from Mumbai. Dr. Smith needs to practice in New Delhi, so he applies to have his medical credentials registered in the National Register. The Ethics and Medical Registration Board, as per Section 27(1)(a) of The National Medical Commission Act, 2019, is responsible for maintaining this National Register. They will include Dr. Smith's information, ensuring that he is recognized as a licensed medical practitioner across India.
Now, suppose Dr. Smith is accused of unethical behavior in his practice. The State Medical Council of Delhi, empowered by their State Act, begins an investigation. According to Section 27(1)(b), the Ethics and Medical Registration Board would oversee the investigation to ensure it complies with the national code of professional and ethical conduct. If Dr. Smith is found guilty and penalized by the State Medical Council, he could appeal to the Ethics and Medical Registration Board, invoking their appellate jurisdiction under Section 27(1)(d).
Additionally, if the Ethics and Medical Registration Board identifies systemic issues in the conduct of medical professionals in various states, as per Section 27(2), they can recommend new guidelines to the National Medical Commission to improve medical ethics nationwide.
