Explanation using Example
Imagine that the government has decided to widen a national highway, which requires acquiring a portion of Mr. Sharma's farmland that lies adjacent to the highway. Under Section 3G of The National Highways Act, 1956, Mr. Sharma is entitled to compensation for the land acquired.
The competent authority will issue an order determining the amount of compensation based on factors like the market value of the land and any damages incurred by Mr. Sharma due to the acquisition. If Mr. Sharma feels the compensation offered is inadequate, he has the right to have the amount reassessed by an arbitrator appointed by the Central Government.
Before the amount is determined, a public notice will be published in local newspapers, one in the local language, inviting claims from interested parties. Mr. Sharma will have the opportunity to present his case, stating his interest in the land, at the specified time and place mentioned in the notice.
If Mr. Sharma is forced to relocate his residence due to the acquisition, the compensation may also include reasonable expenses related to this change.
