Explanation using Example

Imagine a scenario where an individual, Mr. Sharma, is suspected of being involved in the illegal drug trade. Law enforcement investigates and discovers that Mr. Sharma has recently purchased a luxury car and a beach house. The funds used to acquire these assets cannot be satisfactorily accounted for by his known sources of income.

Under Section 68C of The Narcotic Drugs and Psychotropic Substances Act, 1985, the authorities determine that these assets may be considered 'illegally acquired property' as they may have been purchased with the proceeds of drug trafficking.

Since Mr. Sharma is unable to prove that the assets were obtained legally, and if it is found that the property was acquired after his involvement in drug-related activities, the luxury car and beach house may be forfeited to the Central Government. The forfeiture would be carried out in accordance with the provisions of this Chapter of the Act.
