Imagine a scenario where Mr. Sharma is driving his car and unfortunately gets into a serious accident, resulting in injuries to a pedestrian, Mr. Gupta. Mr. Gupta wants to claim compensation for his medical expenses and the trauma he suffered due to the accident. Under Section 165 of The Motor Vehicles Act, 1988, the State Government has established a Motor Accidents Claims Tribunal in Mr. Gupta's area. Mr. Gupta can approach this tribunal to file his claim for compensation.
The Claims Tribunal, which may consist of a retired Judge of a High Court or someone qualified to be appointed as a Judge, is tasked with adjudicating Mr. Gupta's claim. The tribunal will hear the case, examine the evidence, and decide the amount of compensation Mr. Sharma's insurance company must pay to Mr. Gupta.
