Imagine Sarah was walking across a pedestrian crossing when a car ran a red light and hit her, resulting in grievous injuries. Under Section 164 of The Motor Vehicles Act, 1988, Sarah does not need to prove that the driver or the car owner was at fault to claim compensation. The car owner or their insurance company is liable to pay Sarah a sum of two and a half lakh rupees for the grievous hurt she suffered due to the accident. If Sarah had already received some compensation from another source under a different law, that amount would be deducted from the compensation payable under this Act.
