Explanation using Example
Imagine a scenario where Mr. Sharma owns a bus transport company and holds a permit for operating his buses on a particular route. His permit is set to expire on June 30th, 2023. According to Section 81 of The Motor Vehicles Act, 1988:
- Mr. Sharma must ensure that he applies for a renewal of his permit at least fifteen days before the expiry date, which means he should apply by June 15th, 2023, to avoid any disruption in his service.
- If Mr. Sharma fails to apply by June 15th but has a valid reason, for example, he was hospitalized and could not submit the application in time, the Regional Transport Authority may still accept his late renewal application.
- However, if Mr. Sharma had been found guilty of operating without paying vehicle tax or using unauthorized routes more than twice in the past year, his renewal application could be denied after giving him a chance to be heard.
- If Mr. Sharma's permit is renewed after June 30th, the new permit period will start from the date of expiry of the old permit, and if he had to get a temporary permit in the meantime, the fee for that temporary permit would be refunded to him.
