Explanation using Example
Imagine that Mr. Sharma owns a car which was involved in a severe accident and is now beyond repair. According to Section 55(1) of The Motor Vehicles Act, 1988, Mr. Sharma must report this to the local registering authority where he resides within fourteen days. He must also submit the vehicle's certificate of registration for cancellation.
Upon receiving the information and the certificate of registration, the local registering authority, under Section 55(2), will cancel the registration if it is the original authority where the car was registered. If not, it will forward the documents to the original registering authority to carry out the cancellation.
If Mr. Sharma does not report the destruction of his vehicle, the registering authority, under Section 55(3), may independently order an examination of the car. If the authority deems the car incapable of use or a danger to the public, it can cancel the registration after giving Mr. Sharma a chance to present his case.
Moreover, if Mr. Sharma had moved his vehicle permanently out of India, under Section 55(4), the registering authority would cancel the car's registration upon being informed of this fact.
In another scenario, if the registering authority discovered that Mr. Sharma obtained the registration through false documents or misrepresented facts, under Section 55(5), it would cancel the registration after providing Mr. Sharma an opportunity to respond.
Furthermore, if Mr. Sharma's vehicle was used in committing a certain offense, under Section 55(5A), the registering authority could cancel the registration for a year, with the provision for Mr. Sharma to apply for a fresh registration later.
Upon cancellation of the registration, as per Section 55(6), the authority would inform Mr. Sharma, who must then return the certificate of registration to the authority.
The registering authority, following Section 55(7), would then remove the vehicle's record from its database or, if it is not the original authority, would forward the certificate to the original authority for cancellation.
