Explanation using Example
Imagine John sells his car to Alice. The car is registered in the same state where the sale takes place. According to Section 50 of The Motor Vehicles Act, 1988:
- John (the transferor) must report the sale to the local registering authority within 14 days. He must fill out the prescribed form, attach the necessary documents, and follow the procedure set by the Central Government. He also needs to send a copy of this report to Alice (the transferee).
- Alice has 30 days to report the transfer to the registering authority where she lives or has her business, and where the car will usually be kept. She must send them the car's registration certificate, the prescribed fee, and a copy of the report she received from John to have the transfer of ownership recorded on the certificate of registration.
If either John or Alice fails to report the transfer within the specified time, the registering authority may impose a fine of up to one hundred rupees, provided they do not take action against them under section 177 of the Act for this lapse.
