Explanation using Example

Imagine a scenario where the Lokpal receives a complaint alleging corruption by a high-ranking government official. After reviewing the complaint, the Lokpal decides that there is merit in the allegation and it needs a thorough investigation.

In accordance with Section 25(1) of The Lokpal and Lokayuktas Act, 2013, the Lokpal refers this case to the Delhi Special Police Establishment (DSPE) - commonly known as the CBI - for a preliminary inquiry. While the Lokpal has the authority to oversee the DSPE's handling of the case, it cannot dictate how the investigation should be conducted or its outcome.

As the investigation progresses, under Section 25(3), if the need arises to transfer the officer handling this sensitive case, the DSPE must seek approval from the Lokpal to ensure that the investigation remains unaffected.

To ensure the case is prosecuted effectively in court, as per Section 25(4), the DSPE, with the Lokpal’s consent, appoints a panel of independent advocates to take the matter to trial.

Throughout the process, the Lokpal monitors the progress and, if necessary, under Section 25(2), can issue guidelines to the DSPE to ensure the investigation is conducted efficiently and reaches a conclusion expeditiously.

Finally, recognizing the need for adequate resources, as per Section 25(5), the Central Government allots funds specifically for the investigation of this case, ensuring the DSPE has all the necessary tools to conduct a thorough investigation.
