Explanation using Example

Imagine a scenario where the position of the Chairperson of the Lokpal becomes vacant due to retirement. To fill this vacancy, the President of India must appoint a new Chairperson based on the recommendations of the Selection Committee. This committee is composed of the Prime Minister as the Chairperson, the Speaker of the House of the People, the Leader of Opposition in the House of the People, the Chief Justice of India or a Judge of the Supreme Court nominated by him, and an eminent jurist nominated by the President upon the recommendation of the other members.

During the selection process, one of the members of the Selection Committee is unable to participate due to illness. However, as per the provisions of the Act, the absence of this member does not invalidate the appointment process, and the remaining members can proceed with the selection.

To assist in the selection, the Selection Committee forms a Search Committee with at least seven members who have expertise in various fields relevant to the Lokpal's functions. This Search Committee is required to have a diverse composition with at least fifty percent of its members coming from Scheduled Castes, Scheduled Tribes, Other Backward Classes, Minorities, and women. The Search Committee provides a panel of names for consideration, but the Selection Committee is not restricted to these names and may consider other candidates as well.

The Selection Committee follows a transparent procedure to select the most suitable candidate for the Chairperson of the Lokpal. The procedure, the term of the Search Committee, and the allowances for its members are all prescribed by regulations.
