Explanation using Example

Imagine a scenario where Mr. Sharma, a caretaker at a juvenile home, is found to have used physical force as a punishment on one of the children for breaking a rule. A complaint is lodged against him, and after an investigation, Mr. Sharma is convicted for the said act. As per Section 82(1) of The Juvenile Justice (Care and Protection of Children) Act, 2015, Mr. Sharma is fined ten thousand rupees for this first conviction.

If Mr. Sharma repeats this offence, under the same section, he would face imprisonment of up to three months, or a fine, or both. Additionally, as per Section 82(2), he would be dismissed from his service and barred from any future employment that involves direct contact with children.

Furthermore, if the management of the juvenile home tried to obstruct the inquiry into Mr. Sharma's actions or did not comply with the relevant authorities' orders, the person responsible for the management could face a minimum of three years imprisonment and a fine up to one lakh rupees according to Section 82(3).
