Explanation using Example
Imagine a construction company in State A plans to recruit workers from State B. The contractor responsible for recruitment must follow Section 12 of The Inter-State Migrant Workmen Act:
- Within 15 days of hiring workers from State B, the contractor must report the recruitment details to the authorities in both State A and State B.
- Each worker is given a pass book with their photo, employment details, wage rates, and other prescribed information in Hindi, English, and their native language if different.
- When a worker's employment ends, the contractor must submit a return to the authorities in both states, confirming all wages and travel fares for the worker's return to State B have been paid.
- The contractor keeps the pass book updated and makes sure the worker retains it.
This ensures transparency and protection of migrant workers' rights across state lines.
