Explanation using Example

Imagine a company, XYZ Pvt. Ltd., is undergoing liquidation due to insolvency. Big Bank, a secured creditor, has an outstanding loan of $1 million given to XYZ Pvt. Ltd., secured by a mortgage on the company's office building.

Under Section 52 of the Insolvency and Bankruptcy Code, 2016, Big Bank has two options:

  1. Big Bank can relinquish its security interest in the office building to the liquidation estate. The liquidator would then sell the office building and distribute the proceeds to Big Bank and other creditors according to the priority established in Section 53.
