Explanation using Example

Let's consider a hypothetical scenario to understand the application of Section 82 of The Information Technology Act, 2000. Suppose Mr. Sharma is the Controller of Certifying Authorities under The Information Technology Act. One day, he is offered a significant bribe by a local businessman, Mr. Verma, to unlawfully certify his business's digital signature. Mr. Sharma, being an honest officer, refuses and reports this incident to the police. Under Section 82, Mr. Sharma is considered a public servant as per section 21 of the Indian Penal Code. Therefore, Mr. Verma can be charged with attempting to bribe a public servant, a serious offense under the Indian Penal Code.
