Explanation using Example

Let's consider a hypothetical scenario where a company named "TechX" has been accused of breaching certain provisions of the Information Technology Act, 2000. The case has been heard in a lower court and the judgement has been passed against TechX. Disagreeing with the judgement, TechX decides to appeal against the decision.

According to Section 48 of The Information Technology Act, 2000, TechX would take their appeal to the Telecom Disputes Settlement and Appellate Tribunal (TDSAT), which has been established under the Telecom Regulatory Authority of India Act, 1997. This tribunal has been designated as the Appellate Tribunal for the purposes of the IT Act. The jurisdiction, powers, and authority of this tribunal in relation to appeals under the IT Act are determined by the Central Government.
