Explanation using Example

Imagine a scenario where Mrs. Sharma, a resident of Delhi, passes away leaving behind a will. Her son, Mr. Raj Sharma, wants to execute his mother's will and distribute the assets as per her wishes. He approaches the local District Court to apply for the probate of his mother's will. After scrutinizing the will and ensuring that it meets all legal requirements, the District Judge or the appointed District Delegate is convinced that the probate should be granted. As per Section 289 of The Indian Succession Act, 1925, the District Judge then issues the probate under the seal of the Court, in the prescribed form, legally authorizing Mr. Sharma to administer his mother's estate according to the terms of the will.
