Explanation using Example
Imagine a scenario where Mrs. Sharma has recently passed away, leaving behind a will. Her son, Mr. Sharma, wants to ensure that his mother's assets are distributed as per her wishes. To do this, he needs to apply for probate, which is a legal process that confirms the will's validity and gives him the authority to distribute the assets.
As per Section 280 of The Indian Succession Act, 1925, Mr. Sharma must fill out a petition for probate. This petition must include his signature and, if he has hired a lawyer, the signature of his legal representative as well. Additionally, Mr. Sharma must include a verification statement, as outlined in the section, to affirm that the information provided in the petition is true to his knowledge and belief.
Once he has completed these steps, Mr. Sharma can submit the petition to the appropriate court, and after due process, the court may grant him probate, allowing him to administer his mother's estate according to her will.
