Explanation using Example
Imagine a scenario where an individual, named Raj, was previously convicted for rape under Section 376 of the Indian Penal Code. After serving his sentence, Raj is released from prison. A few years later, Raj commits another offence of rape. Upon being caught and tried, the court finds him guilty of the new offence. Since Raj has a prior conviction for a similar crime, under Section 376E of the Indian Penal Code, he is now eligible for harsher punishment. The court sentences him to imprisonment for the remainder of his natural life, considering his repeat offense.
In another instance, suppose Sunita is the manager of a factory where she becomes aware that a supervisor is sexually assaulting an employee within the factory premises. If Sunita decides not to report the crime to the authorities with the intention to protect the supervisor, she could be charged under the Chhattisgarh amendment to Section 376E, specifically under the newly inserted Section 376F, for failing to prevent the crime or report it, thereby abetting the offence.
