Explanation using Example

Imagine a scenario where a college student, Rohan, attends a party where he meets Priya. During the party, Priya becomes heavily intoxicated. Taking advantage of her state, Rohan engages in sexual activity with Priya without her clear consent. Priya, being intoxicated, is unable to understand the nature and consequences of the act.

In this instance, Rohan's actions could be classified as rape under Section 375 of The Indian Penal Code, particularly under clause 5, which states that if the woman's consent is obtained when she is unable to understand the nature and consequences of that to which she gives consent due to intoxication, it is considered rape.
