Explanation using Example

Imagine a person, B, who is driving their car following all traffic rules. Suddenly, a pedestrian, C, darts into the road chasing a ball. B immediately applies the brakes, but due to the wet road surface, the car skids and accidentally hits C, causing injury. B had no intention to harm C and was exercising proper care and caution while driving. According to Section 80 of The Indian Penal Code, B's act would not be considered an offence as it was an accident without any criminal intention, occurring despite the exercise of proper care and caution in the performance of a lawful act.
