Explanation using Example
Imagine a person is convicted of a crime and sentenced to six months of imprisonment, with a part of it to be served in solitary confinement. According to Section 74 of The Indian Penal Code, 1860, the maximum duration of solitary confinement they can face at any one stretch is fourteen days. Once these fourteen days are completed, they must be given a break of at least fourteen days before they can be put back into solitary confinement. Moreover, during their six-month sentence, they cannot be put in solitary confinement for more than seven days in any given month. This law ensures that while solitary confinement can be used as a punishment, it cannot be imposed in a manner that is excessively harsh or disproportionate.
