Explanation using Example
Imagine Rahul and Priya decide to start a business together selling handmade crafts. They choose the name "Creative Hands" for their partnership. To formalize their business, they decide to register their firm under the Indian Partnership Act, 1932. They go through the following steps:
- They fill out a statement with all the required details, such as the firm name "Creative Hands", the principal place of business in Pune, Maharashtra, and no other business places as they are just starting.
- They include the date they both agreed to become partners, which was January 1, 2023.
- They provide their full names and permanent addresses.
- They decide that the firm will operate for a duration of 10 years.
Rahul and Priya both sign the statement and send it to the Registrar of Pune along with the prescribed fee. They ensure that the firm name does not contain any prohibited words like "Crown" or "Empire".
If they were located in Uttarakhand, they would follow the state amendment by uploading the required documents and details online, digitally signing the statement, and submitting the registration fee electronically. After approval, they would download their registration certificate from the website.
