Explanation using Example
Example 1:
Ravi is involved in a business dispute with his partner, Suresh. Ravi claims that Suresh agreed to certain terms via email, but Suresh denies this. Ravi wants to present the email as evidence in court. According to Section 65A of the Indian Evidence Act 1872, Ravi can prove the contents of the email (an electronic record) by following the provisions of Section 65B. This means Ravi must provide a certificate under Section 65B(4) that identifies the electronic record, describes the manner in which it was produced, and gives details of the device involved in the production of that record.
Example 2:
Priya is accused of cyberbullying through social media posts. The prosecution wants to use screenshots of Priya's posts as evidence. To do this, they must comply with Section 65A, which directs them to Section 65B. The prosecution must produce a certificate under Section 65B(4) that confirms the authenticity of the screenshots, explains how they were captured, and provides information about the device used to capture them. This certificate must be signed by a responsible official who can vouch for the accuracy of the electronic record.
