Explanation using Example
Imagine a scenario where a person, Mr. Sharma, has filed a lawsuit against his neighbor, Mr. Gupta, for causing damage to his property by cutting down a tree that fell on Mr. Sharma's shed. In the court proceedings, evidence can be presented to establish:
- Whether Mr. Gupta actually cut down the tree;
- If the cutting of the tree led to it falling on Mr. Sharma's shed;
- Whether Mr. Gupta intended to cause damage to Mr. Sharma's property.
However, Mr. Sharma cannot introduce evidence of a conversation he overheard where Mr. Gupta allegedly admitted to a third party of cutting down the tree maliciously, if the law of evidence deems such hearsay as inadmissible.
