Imagine a scenario where Rita owns a building (dominant tenement) that relies on the adjoining wall of Suresh's property (servient tenement) for support. According to Section 34 of The Indian Easements Act, 1882, if Suresh decides to remove or alter the wall, Rita cannot claim compensation from Suresh just because the means of support has been removed. Rita would only be entitled to seek compensation if her building suffers actual, substantial damage as a result of Suresh's actions. If no damage occurs, Rita has no right to compensation under this law.
