Explanation using Example

Imagine a situation where a group of farmers in Darjeeling, who are authorized users of the "Darjeeling" tea geographical indication, decide to form a cooperative. One of the farmers, who is moving away, wishes to transfer his right to use the "Darjeeling" tea GI to another farmer outside the cooperative. According to Section 24 of The Geographical Indications of Goods (Registration and Protection) Act, 1999, he cannot assign or transfer his rights to use the "Darjeeling" GI to anyone else, as the right to a registered geographical indication is not transferable or assignable.

However, if the farmer passes away, the right to use the "Darjeeling" geographical indication will pass on to his heir or successor, as per the provision in the law.
