Imagine a scenario where the Indian government wants to regulate the process of its citizens being employed abroad. To achieve this, the government uses Section 15 of The Emigration Act, 1983. The Central Government appoints an official, the Protector General of Emigrants, to oversee and issue permits to employers seeking to hire Indian citizens for jobs outside of India.
For example, a construction company based in the Middle East wants to recruit Indian workers. Before they can legally hire from India, they need to obtain a permit from the competent authority appointed under Section 15. The Protector General of Emigrants, after due diligence, issues the necessary permit to the company, ensuring that the recruitment process complies with Indian emigration laws.
Additionally, if there’s a need to streamline the process in a specific country, the Central Government can authorize a local official, such as a Consulate or Embassy staff member, to issue these permits directly in the foreign country. This local official must then send certified copies of each issued permit back to the Protector General of Emigrants, maintaining a record and oversight of all employment arrangements involving Indian citizens abroad.
