Explanation using Example
Imagine that a furniture company, "ComfySeats Inc.", has registered a new and unique design for an ergonomic office chair on January 1, 2023. According to Section 11(1) of The Designs Act, 2000, ComfySeats Inc. now has exclusive copyright on this chair design for ten years, until December 31, 2032. This means they can produce, sell, and take legal action against anyone who copies their design without permission during this period.
If ComfySeats Inc. wishes to continue their exclusive rights beyond the initial ten years, they must apply for an extension before December 31, 2032, as per Section 11(2). If they do so and pay the required fee, the Controller can extend their copyright for another five years, until December 31, 2037, allowing them to maintain their market advantage with this unique design.
