Explanation using Example
Imagine a company, XYZ Corp, is under investigation by the Competition Commission of India (CCI) for alleged anti-competitive practices. During the investigation, CCI gathers confidential business information from XYZ Corp. According to Section 57 of the Competition Act, 2002, the CCI cannot disclose this sensitive information to anyone outside the investigation without XYZ Corp's written permission, unless it is for the purposes of the Act or in accordance with other applicable laws. So, if a news agency requests access to XYZ Corp's confidential information under the pretense of public interest, the CCI must refuse unless XYZ Corp agrees in writing or the disclosure is mandated by law.
