Explanation using Example
Let's say the Chairperson of the Competition Commission of India (CCI) has been serving for four years and decides to resign. According to Section 10(1) of the Competition Act, 2002, the Chairperson's term is five years, but they can resign before completing the term. The vacancy now created would need to be filled by a new appointment, as per Section 10(2).
Meanwhile, the senior-most Member of the CCI, as per Section 10(4), would act as the interim Chairperson until a new Chairperson is appointed and assumes office. If the outgoing Chairperson had reached the age of sixty-five, they would not be eligible for re-appointment based on the age limit set in Section 10(1).
