Explanation using Example
Imagine a scenario where ABC Pvt. Ltd. is holding its Annual General Meeting (AGM) and needs to send out notices to all its shareholders. According to Section 20 of The Companies Act, 2013, the company can serve these notices by sending them to the shareholders' registered addresses through registered post, speed post, or courier service. They can also leave the notices at the registered office of the company or send them via an electronic mode such as email, if prescribed.
For instance, if the company decides to send the AGM notice via courier, the courier agency will deliver the document to the shareholder and provide proof of delivery to the company, ensuring compliance with the Act. If a shareholder prefers to receive the document through email, they can request this from the company and might have to pay a fee determined by the company during the AGM for this service.
