Example 1:

Scenario: Bribery during elections

Ravi, a candidate in the local municipal elections, offers Rs. 5000 to each voter in his constituency to secure their votes. This act of bribery is reported to the authorities.

Application of the Act:

  • Offense: 171E Bribery
  • Punishment: Ravi could face imprisonment for up to 1 year, or a fine, or both.
  • Cognizability: Non-cognizable (Police cannot arrest without a warrant)
  • Trial Court: Magistrate of the first class

Example 2:

Scenario: Undue influence at an election

Priya, another candidate, threatens the voters in her area that if they do not vote for her, she will ensure that their water supply is cut off. This undue influence is reported to the election commission.

Application of the Act:

  • Offense: 171F Undue influence at an election
  • Punishment: Priya could face imprisonment for up to 1 year, or a fine, or both.
  • Cognizability: Non-cognizable (Police cannot arrest without a warrant)
