Example 1:
Scenario: Rajesh is accused of a minor crime and is granted bail by the court. His friend, Suresh, acts as his surety and signs a bond of ₹50,000. Unfortunately, Suresh passes away suddenly.
Application of Section 447:
- The court that granted Rajesh's bail will now require Rajesh to find a new surety.
- Rajesh must present a new person who can act as his surety and sign a new bond of ₹50,000.
- If Rajesh fails to find a new surety, the court may treat this as a default and could potentially cancel his bail, leading to his re-arrest.
Example 2:
Scenario: Priya is released on bail with her uncle, Ramesh, acting as her surety. Ramesh signs a bond of ₹1,00,000. Later, Ramesh is declared insolvent and cannot fulfill his financial obligations.
