Explanation using Example

Example 1:

Rajesh is convicted of a heinous crime and sentenced to death by the High Court of Delhi. Rajesh decides to appeal this decision to the Supreme Court of India. According to Section 415 of The Code Of Criminal Procedure 1973, the High Court must postpone the execution of Rajesh's death sentence until the time allowed for filing the appeal has expired. If Rajesh files his appeal within this period, the execution will be further postponed until the Supreme Court makes a decision on his appeal.

Example 2:

Sita is sentenced to death by the High Court of Mumbai. She applies to the High Court for a certificate under Article 132 of the Constitution, which would allow her to appeal to the Supreme Court. The High Court must then postpone the execution of Sita's death sentence until her application for the certificate is decided. If the High Court grants the certificate, the execution will be further postponed until the time allowed for filing the appeal to the Supreme Court has expired.

Example 3:

Vikram is sentenced to death by the High Court of Chennai. He informs the High Court that he intends to file a petition for special leave to appeal to the Supreme Court under Article 136 of the Constitution. The High Court, being satisfied with Vikram's intention, orders the postponement of his execution for a sufficient period to allow him to file the petition. This postponement ensures that Vikram has enough time to seek special leave to appeal from the Supreme Court.
