Explanation using Example
Example 1:
Rajesh was convicted of theft and sentenced to six months in prison along with a fine of ₹10,000. The court, while passing the judgment, ordered that ₹7,000 of the fine should be paid to Suresh, the victim, as compensation for the loss of his stolen goods. The remaining ₹3,000 was directed to cover the expenses incurred during the prosecution. This ensures that Suresh receives some financial relief for his loss, and the state recovers part of the costs involved in bringing Rajesh to justice.
Example 2:
Meena was found guilty of causing a car accident that resulted in the death of Ramesh. The court sentenced her to two years in prison and imposed a fine of ₹50,000. The court ordered that ₹40,000 of the fine should be paid to Ramesh's family as compensation for their loss under the Fatal Accidents Act, 1855. The remaining ₹10,000 was allocated to cover the prosecution expenses. This provides some financial support to Ramesh's family while also ensuring that the costs of the legal process are partially recovered.
Example 3:
Anil was convicted of cheating several people by promising them high returns on investments and then absconding with their money. The court sentenced him to three years in prison and imposed a fine of ₹1,00,000. The court ordered that ₹80,000 of the fine should be distributed among the victims as compensation for their financial losses. The remaining ₹20,000 was used to cover the prosecution expenses. This helps the victims recover a portion of their lost money and ensures that the state recovers some of the costs of the trial.
Example 4:
Sunita was convicted of criminal breach of trust for embezzling funds from her employer. The court sentenced her to one year in prison and imposed a fine of ₹30,000. The court ordered that ₹25,000 of the fine should be paid to her employer as compensation for the financial loss. The remaining ₹5,000 was directed to cover the prosecution expenses. This provides some financial relief to the employer and ensures that the costs of the legal process are partially recovered.
Example 5:
Vikram was convicted of causing grievous hurt to Arjun in a fight. The court sentenced him to two years in prison but did not impose a fine. However, the court ordered Vikram to pay ₹20,000 as compensation to Arjun for his medical expenses and suffering. This ensures that Arjun receives some financial support for his recovery, even though no fine was imposed as part of Vikram's sentence.
