Explanation using Example

Example 1:

Ravi is a key witness in a theft case being tried in a Criminal Court in Mumbai. He receives a summons to appear in court on the 15th of June at 10:00 AM. Despite receiving the summons, Ravi decides to ignore it and does not show up in court on the specified date and time. The judge, noticing Ravi's absence, determines that his testimony is crucial for the case and that his non-attendance is without any justifiable reason. The judge decides to take cognizance of Ravi's non-attendance under Section 350 of The Code Of Criminal Procedure 1973. Ravi is given an opportunity to explain his absence, but he fails to provide a valid excuse. Consequently, the judge imposes a fine of Rs. 100 on Ravi for his failure to attend the court as summoned.

Example 2:

Sita is summoned to appear as a witness in a fraud case in a Criminal Court in Delhi. She is required to be present in court on the 20th of July at 11:00 AM. Sita arrives at the court but leaves the premises at 10:30 AM, before her scheduled time to testify, without informing the court officials.
