Scenario: During a criminal trial in a Sessions Court in Mumbai, the accused, Rajesh, repeatedly interrupts the judge by shouting and making derogatory remarks.

Application of Section 345:

  1. The judge observes Rajesh's behavior, which constitutes an offence under Section 228 of the Indian Penal Code (insult or interruption to a public servant sitting in judicial proceeding).
  2. The judge orders the court officers to detain Rajesh in custody.
  3. Before the court session ends for the day, the judge takes cognizance of the offence and gives Rajesh an opportunity to explain his behavior.
  4. After hearing Rajesh's explanation, the judge decides to impose a fine of Rs. 200 on Rajesh.
