Example 1:
Ravi, a resident of Mumbai, has been accused of theft but is found to be of unsound mind and incapable of defending himself in court. He is detained under Section 330 of the Code of Criminal Procedure, 1973. Ravi's brother, Suresh, wishes to take Ravi into his care. Suresh applies to the State Government, providing a security bond ensuring that Ravi will be properly taken care of, will not harm himself or others, and will be produced for regular inspections as directed by the State Government. The State Government, satisfied with the security provided by Suresh, orders that Ravi be delivered to Suresh's care. Suresh ensures Ravi attends all required inspections and, when Ravi is certified by the inspecting officer as capable of making his defense, Suresh produces Ravi before the court for the trial to proceed.
Example 2:
Meena, a resident of Delhi, is accused of assault but is found to be of unsound mind and is detained under Section 335 of the Code of Criminal Procedure, 1973. Meena's friend, Priya, wants to take Meena into her care. Priya applies to the State Government, providing a security bond that guarantees Meena will be well taken care of, will not harm herself or others, and will be produced for inspections as required. The State Government, satisfied with Priya's application and security, orders that Meena be delivered to Priya's care. Priya ensures that Meena attends all required inspections. Later, the inspecting officer certifies that Meena is now capable of making her defense. Priya then produces Meena before the court, and the trial proceeds as per the provisions of Section 332.
