Example 1:

Ravi, a 30-year-old man from Mumbai, is accused of theft. During the trial, it is observed that Ravi exhibits signs of severe mental illness. The court orders a medical examination under Section 328 of the Code of Criminal Procedure, 1973. The medical report confirms that Ravi is suffering from schizophrenia and is incapable of defending himself in court.

The Magistrate, considering the medical report, decides that Ravi cannot be kept in jail due to his mental condition. Ravi's brother, Suresh, undertakes to ensure that Ravi receives regular outpatient psychiatric treatment from a nearby government hospital and promises to prevent Ravi from harming himself or others. Based on this undertaking, the Magistrate orders Ravi's release on bail.
