Explanation using Example
Example 1:
Scenario: Ramesh was convicted by a Magistrate of the second class for a minor theft offense and sentenced to six months in jail. Ramesh believes the conviction was unfair and decides to appeal.
Application of Section 381:
- Ramesh files an appeal to the Court of Session.
- According to Section 381(1), the appeal can be heard by the Sessions Judge or an Additional Sessions Judge.
- However, since Ramesh's conviction was by a Magistrate of the second class, the appeal may also be heard and disposed of by an Assistant Sessions Judge or a Chief Judicial Magistrate.
- The Sessions Judge of the division, through a general or special order, assigns Ramesh's appeal to an Assistant Sessions Judge.
- The Assistant Sessions Judge reviews the case and makes a decision on the appeal.
