Explanation using Example

Example 1:

Scenario: Ramesh is accused of theft from a local grocery store. The police file a charge sheet, and the case is brought before a Magistrate.

  1. Initial Hearing: The Magistrate reviews the case under Section 252 and Section 253 but does not find sufficient grounds to convict Ramesh immediately.
  2. Proceeding with the Trial: According to Section 254(1), the Magistrate decides to proceed with the trial. The prosecution presents its evidence, including witness testimonies and CCTV footage from the grocery store.
  3. Defense Opportunity: Ramesh is given a chance to present his defense. He brings in alibi witnesses who testify that he was at a different location at the time of the theft.
  4. Summoning Witnesses: Under Section 254(2), Ramesh requests the Magistrate to summon a witness who can provide additional evidence supporting his alibi. The Magistrate agrees and issues a summons to the witness. 5...
