Example 1:

Rajesh is charged under Section 307 of the Indian Penal Code (IPC) for attempting to murder his neighbor during a heated argument. The prosecution alleges that Rajesh attacked his neighbor with a knife, intending to kill him. However, during the trial, it is proven that Rajesh did attack his neighbor, but his intention was not to kill, rather to cause serious injury. The court finds that the evidence supports a charge of voluntarily causing grievous hurt under Section 326 of the IPC, which is a lesser offence compared to attempted murder. Therefore, Rajesh can be convicted under Section 326, even though he was initially charged under Section 307.
