Explanation using Example
Example 1:
Ravi is accused of committing three thefts within a year. The first theft occurred in January, the second in April, and the third in November. All three thefts are punishable under Section 379 of the Indian Penal Code. According to Section 219 of The Code of Criminal Procedure 1973, Ravi can be charged and tried for all three thefts in a single trial since they are of the same kind and occurred within twelve months.
Example 2:
Sita is accused of committing two acts of forgery and one act of cheating within a year. The first forgery occurred in February, the second in June, and the cheating occurred in October. Forgery is punishable under Section 465 of the Indian Penal Code, and cheating is punishable under Section 420 of the Indian Penal Code. Since forgery and cheating are not punishable under the same section and do not fall under the same kind of offence as defined in Section 219, Sita cannot be charged and tried for all three offences in a single trial. However, she can be charged and tried for the two acts of forgery together in one trial.
Example 3:
Arjun is accused of committing three acts of house-breaking within a year. The first act occurred in March, the second in July, and the third in December. House-breaking is punishable under Section 454 of the Indian Penal Code. According to Section 219 of The Code of Criminal Procedure 1973, Arjun can be charged and tried for all three acts of house-breaking in a single trial since they are of the same kind and occurred within twelve months.
Example 4:
Meera is accused of committing two acts of theft and one act of attempted theft within a year. The first theft occurred in January, the second in May, and the attempted theft occurred in September. Theft is punishable under Section 379 of the Indian Penal Code, and attempted theft is also considered an offence of the same kind as theft. According to Section 219 of The Code of Criminal Procedure 1973, Meera can be charged and tried for all three offences in a single trial since they are of the same kind and occurred within twelve months.
